Workforce Classification

State laws determine worker classification. It is important to understand the relevant state employment laws to ensure compliance. Under common-law rules, anyone who performs services for you is an employee if you can control what they do and how they do it. This applies even when an employee is given “freedom of action.”

California redefined the criteria for classifying workers with the passage of AB5, which mandates that individuals must be classified as employees based on the three-point “ABC Test.” This is a significant change for many industries that rely on project-based workers.
